CAL Internet Services Modem Account Acceptable
Use Policy
CAL Internet Services has been established to:
1. Provide the highest quality and optimum access of networking
services to the research and educational community of the United States
and Internationally.
2. Offer network resources at the maximum level of cost-efficiency.
3. Facilitate innovation and regional/national competitiveness.
These goals remain the standard for excellence in service and price.
They should not be compromised. It is with these goals in mind that
the Acceptable Use Policies of CAL Internet have been established.
This statement is a guide to the Modem Account Acceptable
Use Policy of CAL Internet. In cases where data communications are
carried across other regional networks or the Internet, CAL Internet
users are advised that acceptable use policies of those other networks
will also apply and may limit use.
Terms and Conditions:
1. Dial-on-demand accounts are not for resale. Dedicated account
users may not resell dial-up access. Dedicated accounts may resell
web services from a customer owned web server. Account users may not
resell any other CAL Internet services.
2. Accounts are billed month to month and canceled month to
month. Payment is due each month following the date the account was
established. After (15) days of non-payment the account will be charged
a late fee in addition to the current service fees. After (30) days
of non-payment, the account will be terminated and all pricing guarantees
will be forfeited. Customer shall pay all collection costs incurred
by CAL Internet Services. Re-instatement of the account will occur
in a reactivation fee. Cancellations must be made in WRITING and will
occur at the end of the current billing cycle in which notice is received.
No refunds will be given. Rates are subject to change without prior
notification.
3. Upgrading may be done at any time. Upgrades will be performed
on a pro-rated basis from the notification date. Downgrading will
occur at the end of the billing cycle in which notification is received.
4. Account sharing is prohibited. Only one modem connection
per account may be established at any given time.
5. Dial-up accounts are not intended for dedicated service.
Dedicated or unmonitored modems connected on a continual basis are
not allowed and may result in account suspension.
6. All services offered by CAL
Internet are to be used in a lawful manner according to federal, state
and local laws, as well as the rules and Acceptable Use Policies created
for Usenet and the Internet as a whole.
7. It is not acceptable to
use CAL Internet in such a way that would interfere with or disrupt
network users, services or equipment. Disruptions include, but are
not limited to, a) distribution of unsolicited advertising (SPAM)
via e-mail, newsgroups or other means, b) propagation of computer
worms and viruses and c) using the network to make unauthorized entry
to any other machine accessible via the network.
8. It is assumed
that information and resources accessible via CAL Internet are private
to the individuals and organizations which own or hold rights to those
resources and information unless specifically stated otherwise by
the owners or holders of the rights to those resources and information.
9. CAL Internet will not be held responsible in any way or for any
reason for damages suffered through the use of CAL Internet Services.
10. CAL Internet will not be held responsible for the phone number
dialed or stored in your modem software. If you have any questions
regarding the local phone numbers, please call our office at 800.953.9525
to speak with a representative.
11. Customers are responsible for
acquiring and maintaining all equipment and software necessary to
connect and to make use of CAL Internet Services. CAL Internet specifically
disclaims any liability or responsibility for the software provided
to you by CAL Internet in order to assist you in connecting to and
making use of CAL Internet Services.
12. CAL Internet reserves the right to terminate service to anyone
for any reason at any time. CAL Internet also reserves the right to
modify these terms and conditions at any time. Changes will be posted
at the CAL Internet web site at http://www.calis.com/policies/modemaccess.html.
Violation and Account Suspension:
1. Violations of the CAL Internet Acceptable Use Policy
(AUP) will be reviewed by the system administrator(s) on a case-by-case
basis.
2. Violations may result in a written warning and/or the account
may be frozen indefinitely (access restricted), depending on the severity
of the violation. An account reactivation fee may be assessed or the
account may be terminated with no refund given.
3. Violations that
are deemed criminal by the California Computer Crime Law or other
laws will result in the account being permanently terminated and no
refund will be given. The proper authorities will be notified in such
a case.
